Congressman signs resolution affirming commitment to two-state settlement, calls for direct talks

Congressman Hank Johnson (GA-04), a member of the House Committees on Armed Services and the Judiciary, today issued the following statement and announced his co-sponsorship of H.Res.268, reaffirming U.S. commitment to a negotiated settlement of the Israeli-Palestinian conflict through direct bilateral negotiations:

“I strongly support President Obama’s efforts to advance the Israeli-Palestinian peace process.  It has long been understood that the framework for an agreement on territory will be the 1967 borders with mutually agreed swaps to accommodate subsequent demographic, political, and security developments. 

“I call upon Hamas in the strongest terms to publically accept Israel’s right to exist; Israel cannot be expected to negotiate with a party that denies its right to statehood. 

“I echo President Obama and Secretary Clinton in urging Palestinian officials to negotiate a settlement with Israel instead of pursuing a unilateral effort to secure recognition of statehood at the United Nations. I look forward to supporting President Obama’s efforts and encourage the parties to return to the table and strike a compromise that will yield a two-state solution.”

Making Home Affordable program is a good start but more must to be done to help homeowners stay in their homes. While foreclosure rates in metro Atlanta are down 8% from last year, they are still way too high. The free event offered homeowners a chance to meet one on one with their lenders, find out if they qualify for President Obama’s Making Home Affordable program and offered the platform for struggling homeowners to work out other options with their lenders. PATENT REFORM = JOBS – This week, I supported the “America Invents Act,” which will foster innovation, economic growth and help America maintain its global competitive edge.  If we are going to improve our economy, we must modernize our patent laws. Currently, there is a massive backlog at the U.S. Patent and Trademark Office (USPTO) to the tune of 700,000 patents pending. The “America Invents Act” includes much needed improvements to the patent system that will streamline the system, drive economic growth and help create jobs by taking the handcuffs off innovation.

EQUAL RIGHTS – In wake of this week’s controversial Supreme Court Wal-Mart decision that will make it more difficult for workers to fight claims of gender discrimination, I stood with my Democratic ERA_e-letter.jpgcolleagues June 22 on Capitol Hill, urging Congress to pass the Equal Rights Amendment (ERA).

The ERA passed Congress in 1972, but fell three states short of the 38 necessary for ratification. It’s 2011 ladies and gentlemen, and full gender equality is not yet a reality. There is still much work to be done and more glass ceilings to shatter. I refuse to stand idly by while women still are paid just 77 cents to the dollar men earn for performing the same job, and the health care system discriminates against women by considering their sex a “pre-existing” condition. While women continue to face gender discrimination in the workplace, I will continue to fight for the ERA to be included in the U.S. Constitution.

Hank_senior-center_e-letter.jpgMEDICARE BENEFITS/SENIORS TOUR – A new report shows that more than 5 million Americans with traditional Medicare – or nearly one in six people with Medicare – took advantage of one or more of the recommended preventive benefits now available for free thanks to the Affordable Care Act. 

To ensure seniors know all of the important preventive benefits now covered at no charge to patients, including the new Annual Wellness Visit benefit created by the Affordable Care Act, I’ve launched Seniors Meet & Greet Tour of Fourth District senior centers. I bring my staff, representatives from the Social Security Administration, Medicare and the Veterans Administration together under one roof. Our first event at South DeKalb Senior Center was a big success. Stay tuned for our next stop later this summer at a senior center near you. MEDICARE AT 45 – Today, virtually all Americans 65 and older have health care coverage. Before Medicare was passed in 1965 only about half our seniors had health insurance, which often left them vulnerable to treatable diseases and illnesses. As we observe the 45th anniversary of Medicare on July 1, I’m proud to have voted for the Affordable Care Act, which will extend Medicare’s solvency for 12 years.

While I’ll fight to defend and preserve Medicare, I’m also concerned about seniors’ ability to afford their prescriptions under Medicare Part D. Due to a system known as “specialty tiers” to classify high-cost drugs, Medicare forces recipients to pay up to 33 percent of a drug’s cost that exceeds $600, as opposed to charging seniors a fixed co-pay amount similar to those used for generic or preferred brand drugs. AFGHANISTAN – Like many of you, I watched President Obama’s speech on Afghanistan Wednesday night. The President has done exactly what he said he would do. Over the next 18 months, 30,000 American soldiers – a third of our committed forces – will return home.

I understand an open-ended, nation-building commitment in Afghanistan is militarily, financially, and politically impossible. If you think the sustained application of American military force can turn Afghanistan into Switzerland by 2014, you’re dreaming.  But we can also all agree that leaving Afghanistan to the Taliban or abandoning it to failed-state status is totally contrary to our interests. 

The President is making good on his commitments. He announced a responsible policy for Afghanistan, and I support him.

NATIONWIDE EMERGENCY ALERT SYSTEM – The U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) and the Federal Communications Commission (FCC) will conduct the first nationwide test of the Emergency Alert System (EAS). The nationwide test will be on Wednesday, November 9 at 2 p.m. EST. The EAS is a national alert and warning system created to enable the President of the United States to address the American public during emergencies. For more information, click HERE.

marta.jpgTRANSPORTATION INVESTMENT ACT FORUM – There’s been a lot of talk recently about the penny sales tax referendum in 2012 that – if passed by voters – would fund transportation projects throughout metro Atlanta for a decade. Elected officials in each of the state’s 12 regions are developing a list of projects. The Partnership for Southern Equity is a holding a forum on the legislation on Thursday, June 30, 2011 from 6:30 to 8:00 p.m. at DeKalb Tech Conference Center, 495 North Indian Creek Drive in Clarkston. More than 20 lenders, representing better than 80 percent of the mortgage market, were on hand to assist stressed homeowners avoid foreclosure.

The event, co-sponsored by the U.S. Department of Treasury, U.S. Department of Housing and Urban Development, Hope Now Alliance, Making Home Affordable and NeighborWorks America, was held Friday, June 17 and Saturday, June 18 at the Georgia International Convention Center.

CHJ_Ms.Lundy_site.jpg"Making Home Affordable program is a good start but more needs to be done," said Rep. Johnson, who passed the first anti-predatory lending law in Georgia as a DeKalb County commissioner in 2001.

"While foreclosure rates in metro Atlanta are down 8% from last year, they are still way too high. Homeowners are stressed. These kinds of events are a positive way to make a difference, but the problem is bigger than one foreclosure prevention event. This is the third Help for Homeowners event we've put together, and I believe we'll be doing another one next year and into the foreseeable future until we get a handle on this crisis."

Since 2009, Johnson’s office has assisted more than 650 residents with pending foreclosures.

The free event offered homeowners a chance to meet one on one with their lenders, find out if they qualify for President Obama’s Making Home Affordable program and offered the platform for struggling homeowners to work out other options with their lenders.

Congressman urges deeper, more candid friendship with Turkey:

 WASHINGTON – Rep. Hank Johnson today published an op-ed in Washington, D.C.’s The Hill newspaper calling for closer ties with the Republic of Turkey.

In “Turkey: Emerging power, valuable friend,” Johnson argues that “a deeper and more candid friendship with Turkey will help the United States pursue its interests and support its values around the world.” 

Calling Turkey “the strongest and truest Muslim democracy in its region,” Johnson praises recent elections and argues that the United States should continue to engage in “candid and respectful dialogue with Turkey’s leaders” to advocate for an open and inclusive political process and press and speech freedoms.

Johnson notes that Turkey is “an emerging regional power and important trading partner with a rapidly modernizing economy” and that “Turkish participation in multilateral security missions (including NATO efforts in Afghanistan, anti-piracy operations in the Gulf of Aden and Operation Unified Protector in Libya) demonstrates greater assertiveness in international affairs.” 

Johnson writes, “This development should be embraced and shaped by the United States, not rejected or contained.”

ATLANTA, GA - Congresista Hank Johnson (GA-04) anunció hoy que él es co-organizador del evento para la comunidad el próximo mes con los congresistas John Lewis y David Scott para ayudar a propietarios de vivienda en dificultades a evitar que pierdan sus casas.

En conjunto con el Departamento del Tesoro de EE.UU., EE.UU. El Proyecto de Ley remediara el fallo de la Corte Suprema de Justicia, restablecería los derechos de los consumidores en los tribunales de justicia

 WASHINGTON, DC -- Hoy, durante una conferencia de prensa, EE.UU. senadores Al Franken (D-Minn.) y Richard Blumenthal (D-Conn.), y EE.UU. representante Hank Johnson (D-GA.) anunció la introducción de una legislación que restablecería los derechos de los consumidores para buscar justicia en los tribunales. La Ley de Arbitraje Ecuánime eliminaría las cláusulas de arbitraje forzoso en empleos, consumidores y casos de derechos civiles. Además,  permitiría a los consumidores y trabajadores elegir el arbitraje después de que un conflicto ha ocurrido.
 
"Los trabajadores y los consumidores no deberían verse obligados a renunciar a su derecho para ser contratado para un trabajo, o para obtener un teléfono celular," dijo el Senador Franken. "He introducido la Ley de Arbitraje Ecuánime para garantizar que los trabajadores y los consumidores tengan derecho a elegir el arbitraje en los litigios, en lugar de estar obligados a ello por las corporaciones."

En AT & T contra Concepción, los consumidores presentaron una demanda contra AT & T por publicidad engañosa. Sin embargo, debido a que el valor de su caso era de sólo $ 30 dólares, su caso se consolidó en una acción de clase. AT & T, intentó bloquear la demanda señalando la cláusula de arbitraje obligatorio en el contrato de servicio, pero los tribunales inferiores aplicando correctamente la ley estatal invalidaron la cláusula de arbitraje, ya que prohibía totalmente las acciones de clase.
 
En su decisión 05/04, la Corte Suprema anuló las decisiones de los tribunales inferiores que tenía por objeto proteger a los consumidores. La mayoría de la corte sostuvo que la Ley Federal de Arbitraje (FAA) prohibía los tribunales estatales a proteger los consumidores de estas cláusulas de arbitraje. Sin embargo, la FAA se aprobó inicialmente para garantizar que los tribunales aplicaran los acuerdos de arbitraje comercial entre dos empresas, no entre empresas y consumidores.  Una interpretación más amplia por parte de la Corte Suprema de la FAA permite a las empresas protegerse de la responsabilidad cuando defraudan a un gran número de clientes en una cantidad relativamente pequeña de dinero.
 
Lo que la Ley de Arbitraje Ecuánime hace:
 
• Restaura la intención original de la FAA, al aclarar el alcance de su aplicación.
• Modifica la FAA mediante la adición de un nuevo capítulo de invalidar los acuerdos que requieren el arbitraje de empleo, los consumidores, o los conflictos de derechos civiles realizadas antes de la disputa.
• Restaura los derechos de los trabajadores y los consumidores para buscar justicia en nuestros tribunales.
• Asegura la transparencia en el litigio civil.
• Protege la integridad de la Ley de Derechos Civiles, la Ley de Igualdad Salarial, el Acta de los Americanos con discapacidades, y la Discriminación por Edad en el Empleo, entre otros.

Defensor de toda la vida de los consumidores y trabajadores en los casos de arbitraje forzoso, en 2009 el Senador Franken aprobó una ley con apoyo bipartidista que limita la financiación a los contratistas de defensa quienes someten a los empleados a un arbitraje obligatorio en el caso de asalto sexual y otras violaciones de derechos civiles. El representante Johnson, un veterano campeón de los trabajadores y derechos de los consumidores, introdujo por primera vez la Ley de Arbitraje Ecuánime en el año 2007.
 
A la conferencia de prensa de hoy, los senadores Franken y Blumenthal y Johnson se les unió el representante de Deepak Gupta, un abogado de Public Citizen, quien argumentó en favor de los consumidores en el caso AT & T contra Concepción ante la Corte Suprema, Hassan Zavareei,   un abogado con Tycko y LLP Zavareei y Zirkin Nancy, el Vicepresidente Ejecutivo de Políticas en la Conferencia de Liderazgo sobre Derechos Civiles y Humanos.

House Natural Resources Subcommittee Holds Hearing on Rep. Johnson’s RARE Act

 WASHINGTON, D.C. –  The House Natural Resources Subcommittee on Energy and Mineral Resources held a hearing this morning to consider H.R. 1314, the RARE Act, introduced earlier this year by Reps. Hank Johnson (GA) and Edward J. Markey (MA).

The Resource Assessment of Rare Earths (RARE) Act directs the U.S. Geological Survey (USGS) to lead a global, multilateral assessment of rare earth element deposits to develop a comprehensive understanding of their distribution around the world.

Rare earth elements (REEs) are critical to high-tech manufacturing, with intensive applications in the clean energy and defense sectors.  China accounts for 97% of global rare earth element production and 59% of the known global reserve base.  Rising REE prices and a growing awareness of their strategic role in energy and defense technologies are driving efforts to ensure adequate U.S. supply of the metals.

Johnson called the bill "a common sense first step toward security in rare earths supply that should enjoy bipartisan support.”  He applauded Subcommittee Chairman Doug Lamborn (CO) for holding the hearing.  "It is a testament to your statesmanship that you have placed a bill offered by a Democrat on the table for discussion today," said Johnson.

“From wind turbines to solar panels to energy efficient light bulbs, America needs a reliable supply of rare earth materials to manufacture our clean energy future,” said Markey. “Unfortunately, we have gone from self reliance in the production of our rare earth materials to 100 percent reliance on imports, mostly from China. This bill will help reverse that troubling trend and give industry the tools and information to get America back in the rare earths business.”

Jeff L. Doebrich, Acting Mineral Resources Program Coordinator at USGS, testified that the "Department of the Interior supports the goals of this bill" and that "a global assessment of undiscovered RE resources" is a "logical next step" for U.S. policy.

Jim Engdahl, President and CEO of Great Western Minerals Group, testified that the RARE Act offers "important elements of a much-needed comprehensive solution to challenges in developing a complete, reliable and competitive rare earth supply-chain in the United States."

The bill was featured last month as one of twenty-five in the Democratic Caucus’ “Make it in America Agenda.”
