 ‘Consumer Protection Agency’ to protect families, small businesses:

 WASHINGTON, D.C. – Rep. Hank Johnson today voted to protect consumers by reining in Wall Street and big banks that under President George W. Bush ran amok with no accountability and cost the nation 8 million jobs.

The Dodd-Frank Wall Street Reform and Consumer Protection Act creates a new Consumer Financial Protection Agency to protect families and small businesses by ensuring that bank loans, mortgages and credit cards are fair, affordable, understandable and transparent.

“Wall Street reform is an important step in our path to recovery,” said Johnson.

“This legislation creates a new Consumer Financial Protection Agency, empowers oversight bodies like the Securities and Exchange Commission and helps to dismantle 'too big to fail' firms. 

In short, Wall Street reform prevents the irresponsible behaviors and practices that led to the financial crisis in the first place.”

As Chairman of the Judiciary Subcommittee on Courts and Competition Policy, Rep. Johnson investigated the role large financial institutions played in the Great Recession.

Recommendations from the subcommittee led legislators to include in the bill amendments that will end predatory lending and shut down “too big to fail” financial firms before risky and irresponsible behavior threatens to bring down the economy.
 
“I must however add that I am disappointed the burden is being shifted from hedge fund managers to regular commercial and community banks due to the actions of one senator. Rather than tax the big banks and hedge funds that caused this problem to begin with, Senate Republicans are using TARP money that was supposed to go towards paying down the deficit. Those billions of dollars that would have helped pay down the deficit will now have to come from the American people.”

“This bill is not perfect but it does send us in a new direction that will benefit our economy and provides the framework for future improvements.”

Esta semana, la Cámara de Representantes aprobó el proyecto de ley de Protección al Consumidor de las Tarjetas Telefónicas (H.R. 3993). Poniendo a Latinos en Control de Su Seguro Medico

Asegurando la Seguridad de Estudiantes en la Internet

El Comité de Educación y Trabajo de la Cámara de Representantes tuvo una audiencia legislativa este semana sobre la seguridad de estudiantes en la Internet, ya que el numero de ciber-amenazas ha alcanzado proporciones épicas en comunidades y familias estadounidenses. Entre Latinos, el 80 por ciento de los hijos de inmigrantes usan la Internet, y jóvenes se mete a la red por lo menos una vez al día. El Comité examino preocupaciones sobre el uso de la Internet entre estudiantes, la red social, y otras tecnologías, y exploro el papel que comunidades pueden tomar para mantener estudiantes seguros.

‘Jobs are the No. 1 priority in our community’:

CONYERS, GA – Rep. Hank Johnson is holding his third Career Expo in the past 14 months to help residents find work, plan a new career or bolster their interviewing skills.  The expo is Friday, July 9 at the Rockdale County Career Academy in Conyers.

The expo is being held in conjunction with Rockdale County.

With Rockdale County’s unemployment rate hovering around 12 percent and DeKalb County at 10.7 percent, Johnson said it’s important to continue bringing federal investment to our community.

“The Recovery Act has created jobs at road improvement projects on Covington Highway, South and North Hairston Roads, Sigman Road and Chamblee-Dunwoody Parkway. It has created jobs at Goodwill Industries of North Georgia, DeKalb Tech, saved more than a thousand teaching jobs throughout the district and helped hire more firefighters and police officers. 

“But we’re not out of the woods yet. My staff and I have worked tirelessly to provide our local economy a spark and we won't let up until everyone who is looking for a job has one and local businesses are thriving.”

Participants will learn how to apply for available federal jobs, learn about Georgia’s Work Ready Program, the GI Bill and on-the-job training for veterans and special tips for the over-55 job seeker.

The agencies in attendance include but are not limited to: the DeKalb County Police Department, Department of Labor, Clayton State University, Georgia Perimeter College, Federal Aviation Administration, Fort McPherson and Walton College.

There will also be counselors on hand to share information for résumé writing 101, and how to prepare for an interview and green jobs training opportunities.  A special symposium will be offered for job-seekers who have been incarcerated with information on how to re-enter the workforce.

Participants should bring multiple copies of their résumés and dress for success.

House Republicans unsuccessfully fight effort to reduce corporate, foreign influence in U.S. elections:
 
WASHINGTON, DC – Today, Rep. Hank Johnson voted for the DISCLOSE Act, a bill to reduce corporate and foreign influence in U.S. elections by tightening disclosure and transparency requirements.  The legislation narrowly passed the House of Representatives.  Only two Republicans voted for the bill.

“Why are Republicans opposed to restricting corporate political influence?  Let’s cut right down to it: Republicans favor big business.  They know that increased corporate influence in elections means more Republicans will be elected,” said Rep. Johnson. 

“This bill will limit the political influence of corporate miscreants like BP.  Last week, we saw House Republicans apologize to BP after this Congress and President Obama moved to hold them accountable. This week, Republicans are fighting for BP’s right to influence our elections.”
 
The DISCLOSE Act requires corporations, organizations, and special interest groups to stand by their political advertising just like a candidate for office does.
 
It has been subject to extensive bipartisan debate, including six public hearings, and contains both Democratic and Republican amendments. 

“I believe in bi-partisanship,” Johnson added. “But when only two Republicans can free themselves from corporate influence long enough to vote for a bill to prevent special interests from taking over our elections, it is obvious the other side of the aisle has no interest in bi-partisanship.”

The DISCLOSE Act has strong support from the campaign finance reform community and been endorsed by Common Cause, League of Women Voters, Public Citizen, Campaign Legal Center, Citizens for Responsibility and Ethics in Washington (CREW), and Democracy 21, among many other organizations.

Dear Friends,

While the most recent Georgia employment report had some positive signs that the economy is recovering, we must do more to spur private sector job creation. Small businesses are the engine of our economy, and it’s why I voted this week for The Small Business Jobs and Credit Act and Small Business Jobs Tax Relief Act.

The two bills – now combined – will provide tax cuts for small businesses to help them grow and create new jobs.  The legislation leverages up to $300 billion in loans for small businesses through a $30 billion lending fund for small and medium-sized community banks, which focuses on lending to small firms, and $2 billion for innovative state lending programs supporting small businesses. The program is fully paid for by closing tax loopholes and complies with the Pay-Go budget law. For more on this bill, click here.

RECOVERY ACT, ENERGY GRANTS AND JOBS: I’m pleased to announce that the Association of Energy Engineers in Atlanta will receive $462,000 under the Recovery Act to develop a training program for Commercial Buildings Efficiency Experts. The grant is part of a $76 million, 58-project effort to help make the nation’s buildings more energy efficient and cost-effective. It will also support programs to train workers on how to develop and deploy best practices that will make buildings more energy-efficient – resulting in fewer greenhouse gas emissions and energy cost savings for consumers. PRESERVING PUBLIC TRANSPORTATION: In my new role on the Transportation and Infrastructure Committee, I’m fighting for public transportation. This week, I co-sponsored the Public Transportation Preservation Act of 2010 that would provide transit systems nationwide with $2 billion.

Just as MARTA is grappling with its own budgetary difficulties, public transportation systems around the nation are struggling as well. Many low-income workers, older Americans, and people with disabilities depend on transit service to get to jobs and health care. Reduced service and higher fares can have a devastating effect on their quality of life. For more on this legislation, click here.

JUVENILE ACCOUNTABILITY: The Department of Justice recently awarded Georgia a $1.3 million Juvenile Accountability Block Grant. The goal of program is to reduce youth crime and violence.  I will continue to work to strengthen the nation’s juvenile justice system, and support prevention and early intervention programs that are making a difference for young people and their communities. Congressman Henry “Hank” Johnson Jr. represents Georgia's Fourth Congressional District, which includes portions of DeKalb, Rockdale, and Gwinnett counties.

As Regional Whip for Georgia, Florida, Mississippi, and Alabama, Hank serves in the House Democratic leadership. He sits on the House Transportation and Infastructure, Armed Services and Judiciary committees and is chairman of the Judiciary Subcommittee on Courts and Competition Policy. He was elected to the historic 110th Congress and, in his first official act, helped install Nancy Pelosi as the first woman Speaker of the House.

Throughout his first term, Hank distinguished himself as a thoughtful legislator who advocates for the concerns of his constituents and citizens across the nation. He vocally opposed the Bush Administration's Wall Street bailout. He voted to raise the minimum wage. He fought for children’s health insurance, more Head Start funding, and to reform “No Child Left Behind.” He secured Federal funds for transportation, for medical facilities -- including Grady Hospital, and for public safety in the District.

He pushed for foreclosure relief and legislation to protect citizens from predatory lending. He voted for tax relief for working families and to punish gas gougers. Hank introduced ethics legislation and he supported stem cell research. With bipartisan support, Hank authored and passed a Resolution calling for an end to the 21-year conflict in Northern Uganda.

A strong voice against the war in Iraq and for the fair treatment of our troops, veterans, and military families, Hank fought for military pay raises, better benefits and quality medical care. Hank visited the troops in Iraq during a time of intense warfare and the first bill he introduced was to protect them. He vehemently opposed war profiteering and worked to close the loopholes manipulated by U.S. companies to avoid accountability while operating overseas.

Serving on the Judiciary Committee, Hank stood up for citizen’s rights. He introduced legislation suppressing mandatory arbitration agreements. He demanded fairness in the Jena 6, Genarlow Wilson, and detainee treatment cases. And he led some of the most engaging discussions in the hearings over dismissal of the U.S. Attorneys. When they refused to comply with Committee subpoenas, Congressman Johnson pushed for contempt citations for former White House Counsel Harriet Miers and Chief of Staff Joshua Bolten and he signed a Resolution urging the resignation of Attornery General Alberto Gonzales.

Committed to constituent services at home in his first year, Hank averaged one Town Hall meeting per month. He launched “Congress on Your Corner,” and participated in a host of community events to hear directly from constituents. His Health Care Town Hall in August 2009 was hailed as a modek for the nation. His two District offices have provided service for over 1,000 constituent cases ranging from passport issues to Social Security complaints and postal service challenges.

Prior to his election, Hank served as a DeKalb County Commissioner where he chaired the Budget Committee and a committee to coordinate planning with the Board of Education.

For nearly three decades, in partnership with his wife, he was a principal in Johnson & Johnson Law Group LLC, practicing law in Decatur where he focused on criminal and civil litigation. For 12 years he served as a Judge in the Magistrate Court of DeKalb County and by designation, he sat as a State Court Judge, presiding over civil and criminal jury trials. The Georgia Supreme Court appointed Hank to serve as a Special Master.

He earned his Juris Doctor at Texas Southern University, Thurgood Marshall School of Law. He received his undergraduate degree from Clark College (now Clark Atlanta University) where he later served as president of the Alumni Association, DeKalb Chapter. Hank is a member of the Omega Psi Phi Fraternity.

In his first run for Congress, Hank unseated a 12-year incumbent in a nationally watched primary runoff (59% to 41%). He won the General Election with 75% of the vote.

Hank is married to Mereda Davis Johnson, Esq. and has two children.

INFLUENCING LEGISLATION
This section focuses on Congressman Johnson’s successful efforts to improve and leave his mark on important legislation moving through Congress. 

Foreign Affairs
1) Introduced H. Res. 782, a bipartisan resolution regarding Iran’s nuclear program, with 54 cosponsors.  Language from H.Res.782 was inserted into the House Foreign Affairs Committee’s “Iranian Refined Petroleum Sanctions Act,” or H.R.2194, legislation that would authorize the President to impose crippling sanctions on Iran’s energy sector should he see fit.

Health
2) H.R. 3962 - the Affordable Health Care for America Act –
a. Congressman Johnson worked to ensure that the recommendations of specialty medical associations, patient advocacy groups, and scientific societies are considered as part of the minimum benefit package by the Task Force for Clinical Preventive Services.  Currently, when the task force has insufficient evidence to recommend a service, it provides an “I” or insufficient evidence grade.  Many valuable preventive interventions do not yet have the evidence base needed to obtain a positive recommendation. Others can never be evaluated using the gold standard of a randomized clinical trial because a trial would be too expensive, recruiting participants is not feasible, or investigator interest or funding is lacking.  Congressman Johnson worked to include report language in H.R. 3962, the Affordable Health Care for America Act, which clarifies that the benefits commission can look beyond Task Force recommendations to other sources of evidence and that the commission can consider the recommendations of specialty medical associations, patient advocacy groups, and scientific societies as part of the minimum benefits package.
b. Congressman Johnson worked with his colleague, Mr. Green of Texas, on sec. 2587 of H.R. 3962, the Affordable Health Care for America Act, which requires a report to Congress on the current state of parasitic diseases that have been overlooked among the poorest Americans.  A 2008 study identified high prevalence rates of parasitic infections in the poorest areas of the United States - potentially up to 100 million infections of Acariasis, Chagas Disease, Cysticercosis, Echinococcosis, Toxocariasis, Toxoplasmosis, Trichomoniasis, or Strongyloidiasis.  These diseases disproportionately affect minority and impoverished populations, producing effects ranging from asymptomatic infection to asthma-like symptoms, seizures, and death.  These diseases receive less financial support than they deserve with a mere $231,730 of research funding allocated by NIH since 1995.  This discrepancy in funding is known as the “10/90 gap”; a mere 10% of global health research funding is directed towards diseases affecting 90% of the global population.  For example, between 1995 and 2009, the National Institutes of Health funded a mere $231,730 of Toxocariasis research.  The report required by this section would provide an up-to-date evaluation of the current dearth of knowledge regarding the epidemiology of these diseases and the socioeconomic, health and development impact they have on our society.  The Secretary of Health and Human Services will report to Congress on this as well as the appropriate funding required to address neglected diseases of poverty, including neglected parasitic diseases.

a. Congressman Johnson offered and passed an amendment to H.R. 3570 to fix the “phantom signal” problem so the American people will no longer be forced to pay for programming they have not received.  Previously, due to flaws in existing law, broadcasters sometimes paid royalties to content producers even when programming was not actually delivered to subscribers.  The geographical units to which programming is delivered are known as cable systems.  Under Section 111 of the Copyright Act, royalties for the transmission of broadcast signals to cable systems were paid as if the entire cable system received the transmission, even if it was only received by some subscribers within the cable system.  This has been known as the phantom signal problem.  The cost of this flaw in the law was passed down to consumers, who paid for these royalties even though they did not necessarily receive programming.

a. Congressman Johnson offered and passed an amendment to the financial services reform legislation which passed the House. Johnson's amendment would ensure than financial institutions do not abuse the judicial review provisions of the legislation.

• Nov 3, 2009: Introduced H.R.3986, the “Effective Death Penalty Appeals Act,” which would empower federal courts to grant habeas corpus petitions for death row inmates who present newly discovered evidence that demonstrates probable innocence.  It has been endorsed by Amnesty International and the NAACP.  It has received local, national, and international press attention.

WASHINGTON, D.C. – Rep. Hank Johnson (GA-04) today voted for legislation that will leverage $300 billion in lending for small businesses and create hundreds of thousands of jobs. 

The legislation, which expands much-needed lending to small businesses and offers tax incentives to help America’s small businesses grow, is fully paid for and will save taxpayers $1 billion over the next 10 years.

“This bill will create jobs and help boost the quality of life in our communities,” said Johnson. “Small businesses are the economic engine that fuel job growth and will propel our continued recovery. This will give our small businesses the tax cuts and lending they need to be flexible and grow.”

The Small Business Jobs and Credit Act will help small businesses expand through investments in states and small banks that focus on lending to local small businesses.  This new $30 billion lending fund, with tough performance-based incentives and safeguards to ensure that funds go to American small business, will spur job creation across America.  The bill will also help cultivate American innovation through a new public-private partnership designed to channel early stage investment capital to promising new start-ups.

The Small Business Jobs and Credit Act offers tax incentives to spur immediate investments in America’s small businesses.  These reforms will lower the capital gains taxes on small business investments, and increase tax deductions to help entrepreneurs to recover more start-up expenses.

“This legislation is just another part of our ongoing effort to create jobs and put our economy on sound footing for the future,” said Rep. Johnson. “Last year, almost half of the small businesses seeking loans were unable to meet their credit needs.  That is unacceptable.  Democrats in Congress realize the importance of supporting Main Street as we work together to recover from the failed policies of the Bush-era and its recession.”

Johnson also supported the Recovery Act, which extended bonus depreciation for small business capital and equipment investments, doubled small business tax write-offs for capital investments, cut the capital gains tax on investors in small businesses, and eliminated all fees on SBA-backed loans.

Esta semana, el Congreso de mayoría Demócrata aprobó la reforma de la Administración Federal de Vivienda de 2010 (H. R. 5072) para ayudar a desarrollar las oportunidades de propiedad.  La legislación permite que la Administración Federal de Vivienda (FHA) reduzca los requisitos de pagos iniciales para nuevos prestatarios, mientras continua de ofrecer viviendas a precios razonables para familias de bajo recurso y minorías. 

Las reformas también le darán la autoridad a la Administración Federal de Vivienda para que acabe con fraudes hipotecarios, prestamistas fraudulentos, y esos que violan los requisitos de préstamo.  Con 45 por ciento de compradores Latinos de vivienda, esta legislación es bastante importante en ayudar a los Latinos a comprar su primera casa y evitar juicio hipotecario.  Esta ley es parte de los esfuerzos Democráticos para resucitar la industria de vivienda que ha sido especialmente herida por la reciente recesión.  La Administración Federal de Vivienda le ahorrara $2.5 billones a contribuyentes sobre los próximos cinco anos y es apoyada por El Concilio Nacional de La Raza.

Asegurando la Cobertura Asequible de Medicinas para Personas Mayores

Empezando esta semana, personas de mayor edad que pertenecen a Medicare Parte D “agujero de la dona” recibirán un cheque de $250 para  ayudar cubrir sus gastos de medicamentos, gracias a la nueva reforma de salud.  Con la comunidad Latina en mas riesgo de la populación general para deuda medica (35 por ciento versus 20 por ciento) y apoyándose en sus ahorros personales y fondos de retiro (25 por ciento versus 17 por ciento) para pagar por sus costos de medicamentos, estos cheques ofrecerán alivio financiero muy necesitado para la comunidad Latina, en especial para los ancianos y los discapacitados. 

El agujero de la dona es la brecha en la cobertura de medicamentos de Medicare, el resulto de legislación aprobada en 2003 por el Congreso de mayoría Republicana,  de cual ancianos con costos de medicamentos que sobrepasen $2,830 pueden pagar hasta 100% de los costos de sus medicinas hasta que lleguen a un umbral catastrófico.  Medicare continuara a mandar estos reembolsos de una vez y libres de impuestos a través de los próximos meses mediante que personas mayores entran la brecha de cobertura, con un estimado 4 millones de personas recibiendo esta ayuda.  Esos en el agujero de la dona también recibirán un 50% de descuento en medicinas de marca empezando en Enero de 2011, y para 2020, el agujero será completamente cerrado.

Esta semana, la Casa de Representantes tuvo audiencias legislativas sobre la economía y en desempleo:

• El Comité de Presupuesto tuvo una audiencia legislativa titulada Estado de la Economía con el enfoque sobre el futuro económico de la nación.  La Reserva Federal predice que la actividad económica y el gasto de los consumidores se fortalecerá a un paso más rápido en los meses siguientes – buenas noticias para los mas de 2.8 millones de Latinos que estuvieron desempleados en Mayo de 2010.

• El Comité de Medios y Arbitrios tuvo una audiencia legislativa sobre el desempleo de largo plazo y en encontrar respuestas posibles para este problema.  Con 6.8 millones de americanos en desempleo de largo plazo, un quinto de los cuales son Latinos, Demócratas están trabajando muy duro para crear crecimiento económico.  Además de esto, la presidente de la Cámara, Nancy Pelosi también nombro a miembros de la Casa de Representantes al comité de conferencia que completaran reforma de Wall Street para proteger nuestra economía de recesiónes inducidas por bancos grandes como la recesión de hoy que ha causado el perdido de mas de 8 millones de trabajos en nuestro país.  Miembros de la conferencia incluyen los Representantes Luis Gutierrez (IL-4) y Nydia Velásquez (NY-12) del Caucus Hispano del Congreso.

MEDICARE CHECKS IN MAIL: I was honored last week to give a presentation on the health care law’s impact on Medicare and seniors to members of the South DeKalb Seniors Center. Our office has given a half dozen of these briefings to seniors and teachers throughout the district so I thank the center for having me last week.

On that note, Medicare began mailing out the $250 checks this week for seniors on Medicare who are in the ‘donut hole.’ Under the health reform law, seniors who fall in the donut hole coverage gap in 2010 will receive this one-time, tax-free $250 rebate check. These checks will continue to be mailed monthly over the next several months as seniors enter the coverage gap.

All Medicare recipients who have already paid $2,830 for prescriptions this year will receive the checks that will be issued automatically. But please be on the lookout for fraud and scams. Seniors, you do not need to give anyone personal information to receive this check. Scam artists around the country have been preying on seniors expecting this check, calling seniors and telling them they need to give out personal information like Social Security numbers and bank accounts to receive the checks.

GULF OIL SPILL: Like you, I watch every day in horror as images of the worst man-made disaster in U.S. history spills onto the pages of our newspapers, TV screens and computers. Through my committee assignments on Judiciary and Transportation & Infrastructure,

I will be working with my colleagues in the coming weeks to pass legislation providing greater protection for our coasts, holding Big Oil more accountable and ensuring taxpayers aren’t bailing out BP to clean up this historic environmental catastrophe. I am cosponsoring SPILL Act of 2010, which addresses the legal liability issues arising from the Gulf Coast oil spill. Click here to learn more about this legislation.

WALL STREET REFORM: I’ll also be using my role on Judiciary to help finalize legislation to regulate Wall Street. We must prevent the excesses of Wall Street from pushing us into another recession. As Chair of the Subcommittee on Courts and Competition Policy, I’ve held hearings on banks that are “too big to fail.”

I’m confident the final legislation will rein in Wall Street abuses and protect consumers so they are empowered to make the best decisions when getting a home loan, credit cards and investing their hard-earned money. I’ll keep you informed as the House and Senate bills are merged.

 WASHINGTON, D.C. – Rep. Hank Johnson (GA-04) today announced that starting tomorrow, Medicare will begin mailing out to tens of thousands of seniors in Georgia their $250 ‘donut hole’ checks.

“Seniors have enough concerns without having to worry about how they are going to pay for prescriptions that help keep them healthy and active,” said Johnson. “This is one of the many ways the Affordable Health Care for America law is making an impact right away.”

“That’s just not true, and if you get a call like this hang up and call the Attorney General’s office or reach out to DeKalb County Solicitor General Robert James’ office,” said Johnson. “Robert and I are committed to making sure our seniors are safe.”

“Seniors are far too often the targets of scams, abuse and exploitation,” said Solicitor James. “Our office is committed to prosecuting any person who defrauds a senior through harassment, false pretenses and undue influence. We will not let our seniors suffer in silence.”
 
Johnson said the $250 checks are just the first step in reducing prescription drug prices under health care reform. Next year, seniors in the donut hole will get a 50 percent discount on name-brand prescription drugs and a 75 percent discount on generic drugs. The average senior in Georgia on Medicare will save $700 next year on prescription drugs because of health care reform.

Last year, roughly 97,800 Medicare beneficiaries in Georgia hit the donut hole, or gap in Medicare Part D drug coverage (5,400 in District 4), and received no extra help to defray the cost of their prescription drugs.2 Medicare beneficiaries in Georgia who hit the gap this year will automatically be mailed a one-time $250 rebate check. These checks will begin to be mailed to beneficiaries in mid-June and will be mailed monthly throughout the year as new beneficiaries hit the donut hole. The new law continues to provide additional discounts for seniors on Medicare in the years ahead and completely closes the donut hole by 2020.
